However, if you\u2019re curious to learn more about Stamp Duty, and how it affects you, this is the blog for you.<\/p>\n\n\n\n<p id=\"1\">We\u2019ll help you understand this \u2018duty\u2019 and walk you through the different payment methods available to you.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is Stamp Duty?<\/h2>\n\n\n\n<p>Sri Lanka first introduced a tax on official documents with the Stamp Duty Ordinance in 1909. This tax was later replaced by the Stamp Duty Act No. 43 of 1982, which also covered similar fees for other legal matters.<\/p>\n\n\n\n<p>Sri Lanka used to have a stamp duty tax on property and some valuables, but it got put on hold in 2002. In 2006, the government brought it back, but only for a specific list of ten things. So, unless you\u2019re dealing with one of those ten instruments, you don\u2019t need to worry about stamp duty for now.<\/p>\n\n\n\n<p>Those specified instruments are :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>an affidavit,<\/li>\n\n\n\n<li>a policy of insurance,<\/li>\n\n\n\n<li>a warrant to act as notary public,<\/li>\n\n\n\n<li>a periodic lic\u200bense to carry on trade, business, profession or vocation,<\/li>\n\n\n\n<li>a claim, demand or request made by a service provider from the holder of a credit card, for the payment of a stated sum of money, due in respect of a transaction entered into using such credit card;,<\/li>\n\n\n\n<li>a mortgage for a definite sum of money which affects a property,<\/li>\n\n\n\n<li>a promissory note,<\/li>\n\n\n\n<li>a lease or hire of any property,<\/li>\n\n\n\n<li>a receipt or discharge given for any money or other property<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2\">What is Stamp Duty charged for?<\/h2>\n\n\n\n<p>Stamp Duty is charged based on the Stamp Duty (Special Provisions) Act No. 12 of 2006, with updates from Acts No. 10 of 2008 and 13 of 2011 at specified rates, on every specified Instrument,<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>executed,drawn or presented in Sri Lanka;<\/li>\n\n\n\n<li>executed outside Sri Lanka in relation to a property in Sri Lanka and presented in Sri Lanka, (liability arises at the time it is presented in Sri Lanka)<\/li>\n<\/ul>\n\n\n\n<p>subject to the&nbsp;<a href=\"https:\/\/www.ird.gov.lk\/en\/Type%20of%20Taxes\/SitePages\/StampDuty.aspx?menuid=1209\" target=\"_blank\" rel=\"noreferrer noopener\">exemptions<\/a>&nbsp;published in the Gazette.<\/p>\n\n\n\n<p>Let\u2019s take a look at how Stamp Duty might be relevant to you in your day-to-day life:<\/p>\n\n\n\n<p>Meet Chamika \ud83d\udc4b\ud83c\udffe<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"300\" src=\"https:\/\/simplebooks25.wpenginepowered.com\/srilanka\/wp-content\/uploads\/sites\/6\/2024\/02\/chamika-1-300x300-1.png\" alt=\"\" class=\"wp-image-25144\" srcset=\"https:\/\/simplebooks.com\/srilanka\/wp-content\/uploads\/sites\/6\/2024\/02\/chamika-1-300x300-1.png 300w, https:\/\/simplebooks.com\/srilanka\/wp-content\/uploads\/sites\/6\/2024\/02\/chamika-1-300x300-1-150x150.png 150w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/figure>\n\n\n\n<p>Chamika started a small Software Development company called Savvy two years ago. He now employs 35 people. And, according to the 9th document (a receipt or discharge given for any money or other property) we\u2019ve mentioned in the chart, LKR 25 needs to be paid as Stamp Duty for each one of these documents.<\/p>\n\n\n\n<p>So, Savvy must pay LKR 875 to the Inland Revenue Department (IRD) as Stamp Duty every month.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><a href=\"https:\/\/www.tax.simplebooks.com\/register\" target=\"_blank\" rel=\" noreferrer noopener\"><img loading=\"lazy\" decoding=\"async\" width=\"620\" height=\"620\" src=\"https:\/\/simplebooks25.wpenginepowered.com\/srilanka\/wp-content\/uploads\/sites\/6\/2023\/01\/Blog-Banner-Option-1.png\" alt=\"\" class=\"wp-image-25886\" srcset=\"https:\/\/simplebooks25.wpenginepowered.com\/srilanka\/wp-content\/uploads\/sites\/6\/2023\/01\/Blog-Banner-Option-1.png 620w, https:\/\/simplebooks25.wpenginepowered.com\/srilanka\/wp-content\/uploads\/sites\/6\/2023\/01\/Blog-Banner-Option-1-480x480.png 480w\" sizes=\"(min-width: 0px) and (max-width: 480px) 480px, (min-width: 481px) 620px, 100vw\" \/><\/a><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"4\">What do you need to pay Stamp Duty for in Sri Lanka?<\/h2>\n\n\n\n<p>1. Salaries<\/p>\n\n\n\n<p>If you\u2019re an employer, you need to deduct Stamp Duty from your employees\u2019 salaries at the point of payment and remit the deducted amount to the IRD.<\/p>\n\n\n\n<p><em>For example: If an employee\u2019s salary is over LKR 25,000, the employer needs to deduct LKR 25 and pay it to the IRD or paste a stamp worth 25.00 rupees.<\/em><\/p>\n\n\n\n<p><em>However, if the company employs over 100 employees, the company is required to register with the IRD and pay the compounded amount.<\/em><\/p>\n\n\n\n<p>2. Property<\/p>\n\n\n\n<p>You need to first go to the provisional council and present your house or land\u2019s valuation. Once you do, the council should give you the estimated payable amount.<\/p>\n\n\n\n<p><em>For example: If you purchase a land and a house for LKR 12,000,000, you are required to obtain a Stamp Duty opinion from the revenue department.<\/em><\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><em>100,000<\/em><\/td><td><em>3%<\/em><\/td><td><em>3,000<\/em><\/td><\/tr><tr><td><em>11,900,000<\/em><\/td><td><em>4%<\/em><\/td><td><em>476,000<\/em><\/td><\/tr><tr><td colspan=\"2\"><strong><em>Total SD payable<\/em><\/strong><\/td><td><strong><em><\/em><\/strong><strong><em><\/em><\/strong><strong><em>479,000<\/em><\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>3. Insurance<\/p>\n\n\n\n<p>Stamp Duty will be included in your insurance payments. The insurance companies will then remit the amount to the IRD.<\/p>\n\n\n\n<p>4. Other<\/p>\n\n\n\n<p>For every other occasion, Stamp Duty documentation and direction will be instructed by lawyers.<\/p>\n\n\n\n<p><strong>Compounding Stamp Duty<\/strong><\/p>\n\n\n\n<p>To compound Stamp Duty, registration with the Department of Inland Revenue is required. The following persons must obtain this registration:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any person issuing an insurance policy<\/li>\n\n\n\n<li>Any authority issuing licenses<\/li>\n\n\n\n<li>Any service provider of credit cards<\/li>\n\n\n\n<li>Any employer with more than 100 employees<\/li>\n\n\n\n<li>Any other person issuing instruments deemed impractical or inexpedient for stamping at the prescribed time and manner<\/li>\n<\/ul>\n\n\n\n<p>Registered compounding authorities are required to compound the relevant Stamp Duty and remit it to the Commissioner General of Inland Revenue quarterly, within 15 days after the end of each quarter. A separate schedule should be maintained for each instrument category, including:<\/p>\n\n\n\n<p>Name of the Instrument: (Policies of Insurance, License, Liquor License, Notary License, Other License, Credit card transactions, Salary receipts, Receipts &amp; Discharges, Bonds &amp; Mortgages, Promissory Notes, and Lease, Rent &amp; Hire).<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td>Serial no<\/td><td>Instrument reference no<\/td><td>Date issued<\/td><td>Nam\u200be of the person to whom the instrument issued<\/td><td>Value of the instrument<\/td><td>Value of stamp duty compounded<\/td><\/tr><tr><td>&nbsp;<\/td><td>&nbsp;<\/td><td>&nbsp;<\/td><td>&nbsp;<\/td><td>&nbsp;<\/td><td>&nbsp;<\/td><\/tr><tr><td>&nbsp;<\/td><td>&nbsp;<\/td><td>&nbsp;<\/td><td>&nbsp;<\/td><td>&nbsp;<\/td><td>&nbsp;<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"5\">How can you pay Stamp Duty in Sri Lanka?<\/h2>\n\n\n\n<p>You have the option of paying Stamp Duty in Sri Lanka in 3 different ways:<\/p>\n\n\n\n<h6 class=\"wp-block-heading\">Method 1: Paste stamps on documents<\/h6>\n\n\n\n<p>You can pay the relevant Stamp Duty of a document or transaction amount by pasting a stamp that is worth the same amount.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\">Method 2: Pay single Stamp Duty Fees to the IRD<\/h6>\n\n\n\n<p>This is relevant to specified instruments or documents relating to a mortgage or lease of any immovable property.<\/p>\n\n\n\n<p>Once you deposit the relevant amount in the bank, the IRD will issue a certificate for the payment.<\/p>\n\n\n\n<p>These payments can be made to No. 7041555 of Commissioner General of Inland Revenue, Bank of Ceylon \u2013 Taprobane Branch.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\">&nbsp;Method 3: Pay compound Stamp Duty fees to the IRD<\/h6>\n\n\n\n<p>This is for when you have to pay compounded Stamp Duty fees to the IRD.<\/p>\n\n\n\n<p>Remember Savvy and the Stamp Duty payments it has to pay for its 35 employees? The compounded Stamp Duty rate is LKR 875.<\/p>\n\n\n\n<p>Savvy can make this compound payment to No. 4153842 of Commissioner General of Inland Revenue at the Bank of Ceylon \u2013Taprobane Branch.<\/p>\n\n\n\n<p>A few things to remember:<\/p>\n\n\n\n<p>You need to use \u2018pay-in-slips\u2019 that have been issued by the Inland Revenue Department for each quarter, to settle the Stamp Duty liability of that quarter. You can go to the IRD and request for \u2018pay-in slips\u2019.<\/p>\n\n\n\n<p>In the absence of system printed pay-in-slips, you are instructed to enter payment period code correctly in the pay-in-slip manually obtai\u200bned.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td>Stamp Duty Compounded Payment<\/td><td>Tax type code<\/td><td>Deadline<\/td><\/tr><tr><td>1st Quarter 2024<\/td><td>24030<\/td><td>15th April 2024<\/td><\/tr><tr><td>2nd Quarter 2024<\/td><td>24060<\/td><td>15th July 2024<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"6\">What are the exemptions granted to Stamp Duty in Sri Lanka?<\/h2>\n\n\n\n<p>Stamp Duty in Sri Lanka has its fair share of exemptions. We\u2019ve mentioned some of the more important ones in this blog.
