Lanka.&nbsp;<\/p>\n\n\n\n<p>If you\u2019re a foreign investor hoping to invest in Sri Lanka, this is where you need to go.<\/p>\n\n\n\n<p>They can also grant your project a number of concessions and incentives.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3\">Setting up under the BOI Sri Lanka&nbsp;<\/h2>\n\n\n\n<p>Engaging with the BOI Sri Lanka works just like any routine activity, foreign direct investments are overseen by a specific act in the country.&nbsp;<\/p>\n\n\n\n<p>\u2018The BOI Act\u2019 is the official legislature that regulates your Foreign Direct class=\"wp-block-list\">\n<li>Setting up a new company under the criteria of Section 17 of the BOI Act.<\/li>\n<\/ol>\n\n\n\n<p>The minimum amount you need to invest will depend on the type of project and industry you choose to engage with. <em>For example: The minimum investment amount for a manufacturing project will be USD 500,000; while the minimum investment amount for developing apartment complexes will be USD 3,000,000.<\/em><\/p>\n\n\n\n<p>2. Expanding a company that already exists in Sri Lanka.<\/p>\n\n\n\n<p>Your project will be overlooked and approved by the Board of Investments in Sri Lanka if you apply under Section 17.&nbsp;<\/p>\n\n\n\n<p>This also means that they will be in charge of:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Granting your project certain exemptions.<\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\">\n<li>Deciding on the application of specific laws such as:<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Customs Ordinance<\/li>\n\n\n\n<li>Inland Revenue Act<\/li>\n\n\n\n<li>Exchange Control Act (this list is also given under the BOI Act).<\/li>\n<\/ul>\n\n\n\n<p>You need to invest the minimum required amount (according to the industry) per project in order to enjoy any of the incentives under this section.&nbsp;<\/p>\n\n\n\n<p>If your project is approved under the requirement of Section 17, you will be granted the benefit of enhanced capital allowances. However, restricted sectors such as printing money and retail trading will still not be allowed under this section.&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\">\n<li>Transferring or issuing new shares of an existing non-BOI company to foreign investors.<\/li>\n<\/ol>\n\n\n\n<p>Your project will first and foremost be governed by the regular laws of Sri Lanka if you apply under Section 16.<\/p>\n\n\n\n<p>The project will also be subjected to ordinary Custom Laws, Exchange Control Regulations as well as IRD laws.<\/p>\n\n\n\n<p>In this instance, foreign investment is allowed without fiscal concessions (tax benefits).<\/p>\n\n\n\n<p>The BOI approves projects that:<\/p>\n\n\n\n<p>i.&nbsp;Allow the entry of foreign investment.<\/p>\n\n\n\n<p>ii.&nbsp;Set up a new company with foreign shareholding.<\/p>\n\n\n\n<p>iii. Transfer or issue new shares in an existing non BOI company to foreign investors.<\/p>\n\n\n\n<p>The minimum investment required to obtain approval under this section is USD 250,000.&nbsp;<\/p>\n\n\n\n<p>This can be done in 2 ways:<\/p>\n\n\n\n<p>&nbsp;i.&nbsp;A 100% foreign investment.<\/p>\n\n\n\n<p>&nbsp;ii.&nbsp;Joint venture investment with a local company.<\/p>\n\n\n\n<p>The application can be downloaded from the links provided by the<a href=\"https:\/\/investsrilanka.com\/setting-up\/\" target=\"_blank\" rel=\"noreferrer noopener\"> BOI website<\/a>.<\/p>\n\n\n\n<p><em>Payments and fees<\/em><\/p>\n\n\n\n<p>The initial application fee is USD 200 + VAT 12%.<\/p>\n\n\n\n<p>Payments made from overseas can be done in the form of a bank draft or cheque.
