It\u2019s filled with complex language and tends to drag on.<br><br>So, if you\u2019ve been having a hard time getting the hang of all the rules or you\u2019re looking for a simplified version of everything you need to know &#8211; this is the blog for you.<br><br>We\u2019ll walk you through all the important bits and pieces of Sri Lankan labour law in this article and make sure you\u2019re well versed in your basics.&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-16018d1d wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button ctat\"><a class=\"wp-block-button__link wp-element-button\" href=\"\/srilanka\/services\/\">Find More About Our Services<\/a><\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2\">Who does labour law in Sri Lanka apply to?<\/h2>\n\n\n\n<p>Today, we\u2019re going to be talking about the Shop and Office Employees (Regulation of Employment and Remuneration) Act No 19 of 1954.<\/p>\n\n\n\n<p>This act was written about the labour laws in Sri Lanka.<\/p>\n\n\n\n<p>The laws in this act apply to every employee working in Shops and Offices in Sri Lanka.<br><br>An important feature to notice about this act is that it applies equally to local employees and foreign employees. It makes no distinction between the two.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3\">Who is an employee?&nbsp;<\/h2>\n\n\n\n<p>An employee is defined as a person who is employed in or about the business of a shop or office.&nbsp;<\/p>\n\n\n\n<p>However, there is one exception to this definition.<\/p>\n\n\n\n<p>If the person under employment works in a bazar or works for charitable\/other purposes that is:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Carried on for either one month or less OR;<\/li>\n\n\n\n<li>In business in connection with funerals OR;<\/li>\n\n\n\n<li>A member of tutorial staff of schools OR;<\/li>\n\n\n\n<li>A watcher or a caretaker<\/li>\n<\/ol>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<div class=\"epyt-video-wrapper\"><iframe loading=\"lazy\"  id=\"_ytid_75851\"  width=\"1080\" height=\"608\"  data-origwidth=\"1080\" data-origheight=\"608\"  data-relstop=\"1\" src=\"https:\/\/www.youtube.com\/embed\/4n-tN-UeDbM?enablejsapi=1&#038;autoplay=0&#038;cc_load_policy=0&#038;cc_lang_pref=&#038;iv_load_policy=1&#038;loop=0&#038;rel=0&#038;fs=1&#038;playsinline=0&#038;autohide=2&#038;theme=dark&#038;color=red&#038;controls=1&#038;disablekb=0&#038;\" class=\"__youtube_prefs__  epyt-is-override  no-lazyload\" title=\"YouTube player\"  allow=\"fullscreen; accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen data-no-lazy=\"1\" data-skipgform_ajax_framebjll=\"\"><\/iframe><\/div>\n<\/div><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"4\">What does the Shop and Office Act talk about?<\/h2>\n\n\n\n<p>Think of it as an instruction manual to being a lawful employer.&nbsp;<\/p>\n\n\n\n<p>Read the act\u2019s laws, and you\u2019ll learn all the rules you need to follow when employing people.&nbsp;<\/p>\n\n\n\n<p>However, the whole thing is very long and written for lawyers &#8211; not everyday folks like you and I.&nbsp;<\/p>\n\n\n\n<p>That\u2019s why, we\u2019ll be talking about all the relevant rules right here today.<br><br>As an employer, you need to know all &#8211; if not the most important rules listed in the act like:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Minimum age of employment&nbsp;<\/li>\n\n\n\n<li>Minimum wages&nbsp;<\/li>\n\n\n\n<li>Regulation of hours of employment&nbsp;<\/li>\n\n\n\n<li>Holidays&nbsp;<\/li>\n\n\n\n<li>Meals&nbsp;<\/li>\n\n\n\n<li>Sanitary and washing facilities&nbsp;<\/li>\n\n\n\n<li>Maintaining records<\/li>\n\n\n\n<li>Maternity benefits&nbsp;<\/li>\n\n\n\n<li>Payments<\/li>\n<\/ol>\n\n\n\n<p>You need to follow all of these rules to a tee.<br><br>Let\u2019s take a look at each of them in-depth!<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Minimum age of employment<\/h3>\n\n\n\n<p>You can only hire an employee that is 16 years old or above.&nbsp;<\/p>\n\n\n\n<p>Anyone who is under the age of 16 cannot be employed.<\/p>\n\n\n\n<p>However, there is one exception to the rule:<\/p>\n\n\n\n<p>If someone is under the age of 16, they can be involved in:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Agri-business activities of their family OR;<\/li>\n\n\n\n<li>In a business activity that is organised for an educational\/charitable purpose<\/li>\n<\/ol>\n\n\n\n<p>But, remember &#8211; this is only okay as long as the person takes part in these activities before or after school.<\/p>\n\n\n\n<p>So, whenever you\u2019re hiring employees, make sure that they meet this age requirement on the date of appointment.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Minimum wages&nbsp;<\/h3>\n\n\n\n<p>The minimum wage for a month is LKR 12,500.&nbsp;<\/p>\n\n\n\n<p>In addition to this, you have to provide your employees with a budgetary allowance of LKR 2,500 + other allowances of LKR 1,000.<\/p>\n\n\n\n<p>This is defined in the National Minimum Wage of Workers Act No. 3 of 2016.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Regulation of hours of employment&nbsp;<\/h3>\n\n\n\n<p>You can\u2019t make an employee work over 8 hours a day.<\/p>\n\n\n\n<p>This means that they cannot work more than 45 hours per week.<\/p>\n\n\n\n<p>If in case you need them to work longer than 45 hours a week, you need to pay them overtime.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Overtime<\/h3>\n\n\n\n<p>Overtime is when an employee works beyond their normal hours of work (45 hours).<\/p>\n\n\n\n<p>The amount of overtime hours they can work for per week is limited to 12 hours only, however.&nbsp;&nbsp;<\/p>\n\n\n\n<p>An employee who works overtime has to be paid one and a half times their usual hourly rate.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Holidays<\/h3>\n\n\n\n<p>Under the Shop and Office Act, an employee can take certain types of holidays:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>&nbsp;Weekly holidays<\/li>\n\n\n\n<li>&nbsp;Annual leave<\/li>\n\n\n\n<li>Casual leave or sick leave<\/li>\n\n\n\n<li>Public holidays<\/li>\n\n\n\n<li>Full moon Poya holidays<\/li>\n<\/ol>\n\n\n\n<p>Let\u2019s take a look at each type of holiday.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Weekly holidays<\/h3>\n\n\n\n<p>If your employee works for 28 hours or more every week, they\u2019re entitled to one and a half days of paid leave.&nbsp;<\/p>\n\n\n\n<p>Usually, they get these holidays as a half-day on Saturday and a full day on Sunday.<\/p>\n\n\n\n<p>However, many companies give the entire Saturday off as well.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Annual leave<\/h3>\n\n\n\n<p>Your employees are entitled to 14 days of annual leave a year for every year they\u2019ve worked for.&nbsp;<\/p>\n\n\n\n<p>Annual leave is calculated depending on when the person has been employed.<\/p>\n\n\n\n<p>Legally, leave is calculated depending on the date of employment:<\/p>\n\n\n\n<p>So, this is how your employee\u2019s annual leave would be calculated depending on when they were hired:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Time period the employee was hired on their first year<\/strong><\/td><td><strong>Number of annual leave they\u2019ll be entitled to on their second year<\/strong><\/td><\/tr><tr><td>Between January 1 and March 31<\/td><td>14 days<\/td><\/tr><tr><td>Between April1 and June 30<\/td><td>10 days<\/td><\/tr><tr><td>Between July 1 and September 30 of the previous year<\/td><td>7 days<\/td><\/tr><tr><td>Between October 1 and December 31&nbsp;<\/td><td>4 days<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Remember, this is paid leave. Meaning &#8211; the company pays for these types of leave.&nbsp;<\/p>\n\n\n\n<p>Also, if you terminate your employee, and they still have some of their annual leave left &#8211; they can utilize that as paid leave before the date of termination.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Casual leave or sick leave<\/h3>\n\n\n\n<p>Your employees can take 7 days of paid leave for:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Private matters&nbsp;<\/li>\n\n\n\n<li>Ill health&nbsp;<\/li>\n\n\n\n<li>Or any other reasonable cause<\/li>\n<\/ol>\n\n\n\n<p>This type of leave is also paid for by the company.&nbsp;<\/p>\n\n\n\n<p>Also, this only applies to employees who have been working in your company for over an year.&nbsp;<\/p>\n\n\n\n<p>If they\u2019re in their first year of employment, they can only take one day of casual leave for every two months of service.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Public holidays<\/h3>\n\n\n\n<p>Sri Lanka has a few public holidays on its calendar. These holidays are always paid for by the company (they\u2019re usually Mercantile holidays).<\/p>\n\n\n\n<p>These holidays include:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Independence day<\/li>\n\n\n\n<li>May day&nbsp;<\/li>\n\n\n\n<li>Sinhala and Tamil New Year<\/li>\n\n\n\n<li>Christmas and etc.<\/li>\n<\/ol>\n\n\n\n<p>If you need your employees to work on these holidays, they have to be paid a minimum of twice their daily salary.&nbsp;<\/p>\n\n\n\n<p>You also need to grant your employees paid holidays on all of the full moon poyas. If you require them to work, you need to pay them a minimum of one and a half times the daily salary.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Meals<\/h3>\n\n\n\n<p>If your employees work more than 5 hours a day, you need to give them intervals to eat their meals.&nbsp;<\/p>\n\n\n\n<p>For every four hours of work an employee does, they can take a half an hour break to eat their meals.&nbsp;<\/p>\n\n\n\n<p>So, your average employee (that works 8 hours a day) will get an hour to eat their meals.&nbsp;<\/p>\n\n\n\n<p>In addition, you also have to provide and maintain a suitable place for your employees to have their meals as well.&nbsp;<\/p>\n\n\n[et_pb_section global_module=\"25606 \"][\/et_pb_section]\n\n\n\n<h3 class=\"wp-block-heading\">Sanitary and washing facilities<\/h3>\n\n\n\n<p>You have to provide and maintain a suitable sanitary and washing facility for your employees at your place of work.&nbsp;<\/p>\n\n\n\n<p>You also have to make sure that these facilities are separate for male and female employees.&nbsp;<\/p>\n\n\n\n<p>However, there\u2019s an exception to this rule.&nbsp;<\/p>\n\n\n\n<p>If you can prove to a \u2018prescribed officer\u2019 that suitable sanitary facilities are available within a certain distance, they will give you a certificate exempting you from having an onsite facility.&nbsp;<\/p>\n\n\n\n<p>By the way, this \u2018prescribed officer\u2019 can be:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The Commissioner OR;<\/li>\n\n\n\n<li>The Deputy Commissioner OR;<\/li>\n\n\n\n<li>&nbsp;An Assistant Commissioner<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Records<\/h3>\n\n\n\n<p>You need to keep a few documents and records of your employees at the shop or office like:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>A service record<\/li>\n\n\n\n<li>A remuneration record with the following details:<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Name, age and sex<\/li>\n\n\n\n<li>Grade and designation<\/li>\n\n\n\n<li>Remuneration period<\/li>\n\n\n\n<li>Number of hours of work done<\/li>\n\n\n\n<li>Hours of overtime<\/li>\n\n\n\n<li>Rate of remuneration payable and gross remuneration for the period<\/li>\n\n\n\n<li>Allowances payable<\/li>\n\n\n\n<li>Deductions from gross remuneration<\/li>\n\n\n\n<li>Advances made<\/li>\n\n\n\n<li>Contributions made by employer and employee to a pension or provident fund<\/li>\n\n\n\n<li>Total amount of overtime<\/li>\n\n\n\n<li>Balance remuneration paid and the date of payment<\/li>\n\n\n\n<li>The amount recovered under the Income Tax Ordinance or other law<\/li>\n\n\n\n<li>Acknowledgement of the employee of remuneration received<\/li>\n<\/ul>\n\n\n\n<p>It\u2019s absolutely necessary that you keep these records up to date.&nbsp;<\/p>\n\n\n\n<p>Even after termination, you need to maintain these records for up to two years.<\/p>\n\n\n\n<p>Any other records should be kept for 4 years.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Maternity benefits<\/h3>\n\n\n\n<p>If or when your female employees decide to have children, they\u2019re granted paid leave after the birth of their child\/children.&nbsp;<\/p>\n\n\n\n<p>For the first and second child, they will be entitled to 84 days of paid leave. These 84 days include 14 days of pre-confinement leave as well. This means that your pregnant employee can begin their maternity leave 14 days before their due date.&nbsp;<\/p>\n\n\n\n<p>After the second child, they\u2019re entitled to 42 days of paid maternity leave, with 14 days of pre-confinement leave.<\/p>\n\n\n\n<p>You also can\u2019t terminate her employment because of her pregnancy, or any complications due to the pregnancy.<\/p>\n\n\n\n<p>You can\u2019t also hand out a notice of dismissal during the period of leave.<\/p>\n\n\n\n<p>Maternity leave is in addition to any holidays or annual leave that an ordinary employee is entitled to.<\/p>\n\n\n\n<p>If a female employee is nursing a child under one year, she must be allowed 2 nursing intervals within a period of 9 hours.<\/p>\n\n\n\n<p>If an employee has given notice of her pregnancy, she cannot be employed in any work that could be harmful to her or the child.<\/p>\n\n\n[et_pb_section global_module=\"25275 \"][\/et_pb_section]\n\n\n\n<h3 class=\"wp-block-heading\">Payments to employees<\/h3>\n\n\n\n<p>An employee\u2019s salary must be directly paid to them.<\/p>\n\n\n\n<p>You need to pay them their full amount after making necessary deductions like:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Authorised deductions (example: advance payments):<\/li>\n\n\n\n<li>Deductions according to the Income Tax Ordinance or the Inland Revenue Act;<\/li>\n\n\n\n<li>Any other deduction made or issued by a court of law<\/li>\n<\/ol>\n\n\n\n<p>You need to have a fixed period as to when you pay your employees.&nbsp;<\/p>\n\n\n\n<p>There are a few rules to paying your employees depending on when you pay them:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>You can\u2019t take more than a month to pay your employees<\/li>\n\n\n\n<li>If your payment period doesn\u2019t exceed a week, you have to pay them within 3 days of the end of the period<\/li>\n\n\n\n<li>If your payment period is more than a week, but less than 2 weeks, you have to pay them within 5 days after the end of the period<\/li>\n\n\n\n<li>If your payment period is over within 2 weeks, you have to pay your employee(s) within 10 days of the end of the period<\/li>\n<\/ol>\n\n\n\n<p>An assessment of the salary is possible but it should not be less than the amount paid before.<\/p>\n\n\n\n<p>Now, let\u2019s talk about what the labour laws you have to follow when you either fire an employee or they hand in their resignation.&nbsp;<\/p>\n\n\n\n<p>Well, regardless of whether you terminate their contract or they hand in their resignation &#8211; you need to pay them however much they\u2019re due before the end of the 2nd day after their termination.<\/p>\n\n\n\n<p>Speaking of termination, let\u2019s take a look at what you need to know as an employer about it.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Termination of employment<\/h3>\n\n\n\n<p>There are two acts that talk about termination:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The Industrial Disputes Act (IDA)&nbsp;<\/li>\n\n\n\n<li>The Termination of Employment of Workmen Act (TEWA).<\/li>\n<\/ol>\n\n\n\n<p>Both of them talk about a few common points.<\/p>\n\n\n\n<p>Basically, you can terminate your employees\u2019:<\/p>\n\n\n\n<p>i. &nbsp;&nbsp;With the consent of the employee (e.g. in the form of a resignation) or;<\/p>\n\n\n\n<p>ii. With the written approval of the Commissioner of Labour (COL) or;&nbsp;<\/p>\n\n\n\n<p>iii. With justifiable cause<\/p>\n\n\n\n<p>But what counts as a \u2018justifiable cause\u2019?<\/p>\n\n\n\n<p>Well, they can include:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Misconduct<\/li>\n\n\n\n<li>Unsatisfactory performance<\/li>\n\n\n\n<li>Persistent and unauthorised absence<\/li>\n\n\n\n<li>Abusive\/unruly behaviour<\/li>\n\n\n\n<li>Dishonesty and theft<\/li>\n\n\n\n<li>Intoxication<\/li>\n<\/ol>\n\n\n\n<p>These reasons are all based on discipline issues.&nbsp;<\/p>\n\n\n\n<p>You can also terminate an employee based on non-disciplinary reasons like:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>&nbsp;Inefficiency\/incompetence<\/li>\n\n\n\n<li>Breach of contract<\/li>\n\n\n\n<li>Conviction of an offence<\/li>\n<\/ol>\n\n\n\n<p>Remember, these aren\u2019t the only reasons you can terminate your employees for. There are a few more. However, these will give you an idea of what grounds are accepted by law.<\/p>\n\n\n\n<p>It\u2019s important to remember your employee can challenge their termination.This means that they can file a case against you at the labour court.&nbsp;<\/p>\n\n\n\n<p>If they do, you need to be able to give the courts proof as to why you fired them.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Period of notice<\/h3>\n\n\n\n<p>You need to allow for a period of notice before termination.<\/p>\n\n\n\n<p>It\u2019s important to remember that if an employee is terminated without notice it must be for proper cause.
